Terms of Service — DS Maker LTD

1. Acceptance of Terms

By downloading, installing, or using any application ("App") published by DS Maker LTD ("we," "our," or "us"), a limited company registered in Cyprus, or by accessing our website at dsmaker.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Services

DS Maker LTD develops and publishes iOS applications available on the Apple App Store. Our services include:

Free and paid iOS applications
In-app purchases and premium features
Subscription-based services within our Apps
Customer support and related services

3. User Accounts

Some of our Apps may require you to create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and complete registration information
Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and In-App Purchases

4.1 Billing

All purchases and subscriptions are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions for in-app purchases.

4.2 Subscription Terms

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID account settings
Any unused portion of a free trial period will be forfeited when purchasing a subscription

4.3 Pricing

Prices are displayed in your local currency within the App Store. We reserve the right to modify pricing with reasonable notice. Price changes will not affect active subscription periods.

5. Refund Policy

All purchases are made through the Apple App Store. Refund requests must be submitted directly to Apple, as they handle all payment processing and refunds. To request a refund:

Sign in with your Apple ID
Select the purchase and follow the refund process

DS Maker LTD does not directly process refunds for App Store purchases.

6. Acceptable Use

You agree not to:

Use our Apps for any unlawful purpose
Reverse engineer, decompile, or disassemble our Apps
Attempt to gain unauthorized access to our systems
Distribute, sublicense, or resell our Apps
Use automated systems or bots to interact with our Apps
Upload malicious content, spam, or harmful material
Impersonate any person or entity
Interfere with the proper functioning of our services

7. Intellectual Property

All content, features, functionality, and design of our Apps and Website — including but not limited to text, graphics, logos, icons, images, audio, software, and code — are the exclusive property of DS Maker LTD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal, non-commercial purposes in accordance with these Terms.

8. User Content

If our Apps allow you to create, upload, or share content ("User Content"):

You retain ownership of your User Content
You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely to provide and improve our services
You are solely responsible for your User Content and represent that it does not violate any third-party rights

9. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

OUR APPS AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DS MAKER LTD, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless DS Maker LTD and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of our services or violation of these Terms.

13. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

Your right to use our Apps ceases immediately
All provisions that should survive termination will remain in effect
We may delete your account data in accordance with our Privacy Policy

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our Apps or Website. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DS Maker LTD regarding your use of our services.
